Terms and Conditions
These Terms and Conditions apply when you use www.theory9.in, contact Theory9, make a direct booking, or stay at a Theory9 property. Please read them before confirming a booking. By making a booking or using the booked accommodation or service, you agree to the terms shown during booking, these Terms and Conditions, and any property-specific rules communicated before or at check-in.

Direct and Third-Party Bookings
A booking made through the Theory9 website, a Theory9 property team, telephone, email, or WhatsApp is a direct booking with Theory9.
A booking made through an online travel agency, corporate travel provider, or another third party is also subject to that provider's terms, payment rules, modification process, and cancellation policy. If a third-party booking term conflicts with these Terms and Conditions for that booking, the term disclosed by the third party at the time of purchase will apply to the extent of the conflict.
Booking Eligibility and Guest Information
The person making the booking must be at least 18 years old and legally capable of entering into the booking. The booker is responsible for providing accurate contact, guest, stay, and payment information and for sharing relevant booking terms with all accompanying guests.
Theory9 may request information needed to confirm the booking, meet guest-registration requirements, prevent fraud, or comply with law. A booking may be refused or cancelled if material information is false, incomplete, misleading, or unlawfully provided.
Rates Taxes and Inclusions
Rates are shown in Indian rupees unless another currency is expressly displayed. Applicable taxes, deposits, inclusions, exclusions, meal arrangements, occupancy limits, and any additional charges will be shown in the booking flow, rate plan, quotation, or booking confirmation.
Only the accommodation, amenities, meals, services, or benefits expressly included in the confirmed rate are included. Additional guests, food, transport, laundry, early arrival, late departure, damage, special setup, or another service may carry an additional charge when applicable and disclosed.
Promotional, corporate, weekly, monthly, event, Meeting9, and Night Under the Sky rates may have specific conditions. Those conditions form part of the booking when they are disclosed before confirmation.
Payment
The deposit or full payment required for a booking will be shown before confirmation or stated in the quotation. A booking is confirmed only after Theory9 issues a confirmation and any required payment or payment authorisation has been completed.
Payments may be processed through an authorised payment gateway, bank, online travel agency, or another payment provider. That provider may apply its own processing and security terms. Theory9 may cancel an unconfirmed reservation if a required payment is not received by the stated deadline.
Booking Confirmation and Corrections
Please review the property, room or apartment type, dates, number of guests, rate, taxes, inclusions, and cancellation terms in your confirmation. Contact Theory9 promptly if anything is incorrect.
Bookings remain subject to availability until confirmed. If an obvious pricing, inventory, or description error affects a booking, Theory9 will contact you and offer a correction, a suitable available alternative, or a refund of the amount paid for the affected booking.
Cancellation Policy for Direct Bookings
Unless a different cancellation policy is clearly shown in a specific rate plan, quotation, offer, or booking confirmation, the following policy applies to direct accommodation bookings:
- Cancellation 72 hours or more before the scheduled arrival time: 7 percent of the booking amount will be charged and the remaining amount will be refunded.
- Cancellation within 72 hours of the scheduled arrival time: the full booking amount will be charged.
- No-show: the full booking amount will be charged.
The cancellation request must be sent through the booking channel or to the relevant Theory9 property team. The effective cancellation time is when Theory9 receives the request.
An approved refund will be returned through the original payment method where reasonably possible. The time taken for the amount to appear may depend on the bank, card network, payment provider, or booking platform.
Bookings made through a third party must be cancelled through that party and follow the cancellation and refund terms shown by that party at purchase.
Booking Changes and Early Departure
A request to change dates, property, room type, guest count, or another booking detail is subject to availability and may change the rate, taxes, minimum stay, or cancellation terms. A change is valid only after Theory9 confirms it in writing.
Unused nights, early departure, or a reduced guest count do not automatically qualify for a refund. Theory9 will apply the confirmed rate plan and cancellation terms and may consider a reasonable alternative where availability and operating conditions allow.
Check-In and Check-Out
Check-in and check-out times are shown in the booking confirmation or communicated by the property team. For Theory9 Pali Hill, check-in begins at 2 PM and check-out is by 12 PM unless the confirmation states otherwise.
Early check-in and late check-out are subject to availability and may carry an additional charge. Please tell the property team in advance if you expect to arrive late or need a different arrival arrangement.
Identification and Guest Registration
Guests may be required to provide valid government-issued identification and information required by applicable law or property registration procedures. International guests may be asked for passport, visa, and other details required for lawful registration.
Theory9 may refuse check-in where required identification is not provided, appears invalid, or does not match the booking, subject to applicable law and the confirmed booking terms.
Occupancy Visitors and Use of the Property
The booked accommodation may be used only by the confirmed guests and for the purpose stated in the booking. Occupancy limits, visitor access, event use, and access to shared or private areas must follow the confirmed room type and property rules.
Theory9 offers different formats, including private rooms, studios, multi-bedroom apartments, complete residences, and individual suites within a larger residence. The room description and confirmation identify whether living, kitchen, dining, corridor, or other spaces are private or shared. Guests should review this description before payment and contact Theory9 if they need clarification.
Commercial activity, unlawful conduct, unauthorised events, or use that disturbs other guests, neighbours, or property operations is not permitted.
Guest Conduct and Property Rules
Guests must treat the accommodation, furnishings, equipment, staff, other guests, neighbours, and common areas with care and respect. Noise, nuisance, harassment, unsafe conduct, illegal activity, and damage are not permitted.
Property-specific rules may apply to smoking, pets, parties, music, visitors, cooking, parking, building access, and use of amenities. Theory9 Pali Hill does not permit indoor smoking, pets, parties, or loud music. Any material property-specific rule will be communicated through the booking information, confirmation, or check-in process.
Theory9 may ask a guest to stop conduct that is unsafe, unlawful, disruptive, or contrary to these terms. Serious or repeated breach may result in removal from the property or cancellation of the remaining stay without a refund, subject to applicable law.
Damage Loss and Additional Cleaning
The booker and guests are responsible for damage, loss, missing items, or exceptional cleaning caused by them or their visitors beyond normal use. Theory9 may charge the reasonable documented cost of repair, replacement, or additional cleaning after explaining the basis of the charge.
Please report damage, maintenance concerns, or missing items promptly so the property team can respond during the stay.
Amenities Services and Special Requests
Amenities and services vary by property and room category. Wi-Fi, housekeeping, laundry, kitchen access, food, meeting facilities, spa, gym, rooftop access, parking, and other facilities are available only where included or confirmed for the selected booking.
Special requests are subject to availability and are not guaranteed unless Theory9 confirms them in writing. Temporary interruption may occur because of maintenance, repairs, utility failure, safety requirements, or circumstances outside Theory9's reasonable control. Where a material confirmed service is unavailable, Theory9 will take reasonable steps to restore it or offer an appropriate response based on the circumstances.
Food and Dietary Requests
Food availability and meal inclusions depend on the property and confirmed booking. Guests should disclose allergies or dietary requirements before ordering. Theory9 will take reasonable care when responding to a disclosed requirement but cannot guarantee an environment completely free from a particular allergen unless expressly confirmed.
Personal Belongings and Lost Property
Guests remain responsible for passports, identification, money, jewellery, electronics, luggage, and other personal belongings. Safes should be used where provided. Any loss should be reported promptly to the property team.
Theory9 will make reasonable efforts to locate and return property left behind. Storage duration, verification, collection, courier arrangements, and courier cost may depend on the item and circumstances.
Nothing in this section limits responsibility that cannot lawfully be excluded.
Website Information and Availability
Theory9 aims to keep website descriptions, photographs, rates, availability, and amenity information accurate. Appearance, furnishings, views, and layouts may differ between units within the same category. Current booking information and the written confirmation control where website material is general or has changed.
Website or booking access may occasionally be interrupted for maintenance, security, technical problems, or events outside reasonable control. Theory9 does not guarantee uninterrupted access but will take reasonable steps to maintain the service.
Events Outside Reasonable Control
Theory9 is not responsible for delay or failure caused by an event outside its reasonable control, including natural events, government restrictions, public emergencies, transport disruption, utility or network failure, civil disturbance, or building and safety restrictions.
If such an event materially affects a confirmed stay, Theory9 will communicate the available options and apply the booking terms, applicable law, and any mandatory consumer rights.
Liability and Consumer Rights
Theory9 remains responsible where liability cannot be excluded or limited under applicable law. Nothing in these Terms and Conditions removes a guest's mandatory rights under consumer-protection law.
To the extent permitted by law, Theory9 is not responsible for an indirect or consequential loss that was not reasonably foreseeable when the booking was made. Any assessment will consider the confirmed service, the circumstances, the guest's actions, and applicable law.
Privacy
Theory9 handles personal data according to its Privacy Policy. The policy explains the information collected through enquiries, bookings, website use, payment, check-in, and guest service, together with the available privacy choices and contact details.
Intellectual Property
The Theory9 name, logo, website content, photographs, designs, copy, and other brand materials belong to Theory9, its licensors, or their respective owners. They may not be copied, republished, sold, or used commercially without written permission, except where the law allows limited use.
Third-Party Services and Links
Links to maps, payment providers, social-media platforms, online travel agencies, or other third-party services are provided for convenience or to complete a requested service. Those services operate under their own terms and policies. Theory9 is not responsible for an independent third party's website, availability, or conduct.
Complaints and Support
Please contact the relevant property team promptly if a concern arises. Giving the team an opportunity to respond during the stay may allow the issue to be resolved sooner.
For a booking complaint, include your name, booking reference, property, stay dates, a description of the issue, and the resolution requested. Theory9 will review the available booking and service records and respond through the contact details provided.
Changes to These Terms
Theory9 may update these Terms and Conditions when its services, booking process, or legal obligations change. The terms accepted at the time of booking continue to govern that booking unless a change is required by law or is agreed with the guest.
Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of India. Courts in Mumbai, Maharashtra will have jurisdiction, subject to any mandatory consumer right to bring a claim before another competent authority or forum.
Severability
If a provision of these Terms and Conditions is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
